These User Terms ("ID Terms") govern your access and use of our identity / login services ("Crowdstack ID"), typically used to access our Customer Crowdstack services ("Services"), our online community engagement platform. Thus, the User Terms strictly cover your usage of our ID Services and not your usage of our application Services. We hope you have a great experience!
"We", "us", and "our" refers to Crowdstack, Inc. and its related entities, including Social Strata, Inc. "Services" refers to our Crowdstack services. Our "Customers" are the people that operate our Services (that is, set up and manage a Crowdstack for their business, organization, or group). When we say "you" or "your", we are referring to you, as an end user using ID Services. When we say "Crowdstack ID", we are referring to a registered user account with Crowdstack, typically used to sign into Services.
When you create and manage a Crowdstack ID, you are using an account that is controlled/manage by us, not our Customers. The only information we pass along to our Customers, when join a Customer site using Crowdstack ID, is your email address. This means that our Customers never have access to your password and the profiles you establish on those sites are unique per Customer account.
Each Crowdstack that you access or participate in is managed by one of our Customers. We provide the Services for each Customer but have no role in the management of each Crowdstack. Thus, please keep in mind that we cannot assist you with actions taken in each Crowdstack, since we have no management authority there. You may also be subject to specific rules and terms set by each Customer's Crowdstack that you visit/join.
While our Customers own the data in each Crowdstack, you have the right to withdraw your data from any Crowdstack site where you are using a Crowdstack ID. You have the right to cancel your membership with any Crowdstack service that uses Crowdstack ID for registration, as well as remove your content/data from those sites, and we provide you with a mechanism to do so.
You may also cancel your Crowdstack ID account at any time; though please note that when you do that, you will automatically lose access to any Crowdstack where you were using your Crowdstack ID.
If you have any questions, issues, or concerns, you contact us via email at [email protected].
You understand and agree that we shall not be liable to you or any other third party for any direct, indirect, consequential, exemplary, incidental, special, or punitive damages, including, but not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses from your use of the Service (or your inability to use it), even if we have been advised of the possibility of such damages.
We aren't responsible for any bad actions taken by you, other Users on the Services, or our Customers, and thus you indemnify and hold us and any of our related parties (subsidiaries, affiliates, agents, employees, partners, related entities or licensors) harmless from any claim or demand, including attorneys' fees, made by any third party due to or arising from actions taken on Services that you use.
To the maximum extent permitted by law, you hereby acknowledge and agree that consumer laws do not apply. If however any consumer laws do apply and cannot otherwise be lawfully excluded, nothing in these ID Terms will restrict, exclude or modify any statutory warranties, guarantees, rights or remedies you have.
If a legal dispute arises, our goal is to provide you with a neutral and cost-effective means of resolving it quickly. Accordingly, you and we agree that any controversy or claim at law or equity that arises shall be resolved by arbitration, in a court of law, or as otherwise mutually agreed upon in writing by the parties. Before resorting to these alternatives, we encourage you to contact us directly to seek a resolution.
